1. Who we are
ColorSLCT (“the Service”) is a browser-based color palette tool operated by BNDR LLC (“we”, “us”), Arizona, United States. Contact: support@bndrllc.com.
2. What the Service is
ColorSLCT is a local-first web application. It runs entirely in your browser. We do not operate accounts, servers that store your palettes, or analytics. By using the Service you accept these Terms; if you do not accept them, please do not use the Service.
3. Free plan and Pro license
- The free plan may be used for personal and commercial work at no charge.
- “Pro” is a paid, one-time, perpetual license for one person. It unlocks additional export formats and an unlimited palette library on the browsers where you activate it.
- Pro is unlocked with a license key (issued at purchase) or a gift code (issued at our discretion). You may not resell, share publicly, or distribute keys or gift codes.
- Purchases are processed by third-party merchants (Gumroad and/or Stripe). Their terms and privacy policies apply to the payment itself. We never see or store your card details.
4. Refunds
If Pro doesn’t work as described on a supported, modern browser, contact us within 14 days of purchase at support@bndrllc.com and we will make it right or refund you. Refunds are issued through the same payment processor used at purchase. Statutory consumer rights in your country remain unaffected.
5. Your content
Palettes, names, and exports you create are yours. Because they are stored only on your device, you are responsible for backing them up (for example by exporting or saving share links). Clearing your browser data, declining storage consent, or using private browsing can remove them.
6. Optional third-party features
- AI suggestions send your prompt, your current palette, and your own DeepSeek API key directly from your browser to DeepSeek’s API. Your use of DeepSeek is governed by DeepSeek’s terms. We never receive your key.
- License verification sends the license key you enter directly from your browser to Gumroad’s license API to confirm the purchase.
7. Acceptable use
Do not attempt to misuse the Service, circumvent the license system other than with a key or code we issued, or use the Service in violation of applicable law.
8. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Contrast calculations follow the WCAG 2.x formula, but you remain responsible for verifying accessibility compliance of your own products.
9. Limitation of liability
To the maximum extent permitted by law, BNDR LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim (or $29 if greater).
10. Changes
We may update the Service and these Terms. Material changes will be reflected by the “Last updated” date above. Continued use after changes means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules. Venue for disputes lies in the state or federal courts located in Arizona, unless mandatory consumer law where you live provides otherwise.
